1. Acceptance of T&Cs

These terms and conditions apply to the purchase by Customers of Pearson qualifications (“Products”).  The Customer agrees to these T&Cs by submission of registrations, entries/orders for tests (including onscreen tests and examination papers), and assessments. These T&Cs constitute the entire Product purchase agreement between Pearson and the Customer. If any provision of the T&Cs is found to be illegal or unenforceable, the remaining provisions will be enforced. These T&Cs may not be waived or modified except by prior written agreement.

2. Your order

Subject to the Returns Policy in these T&Cs, by submitting registrations, entries or orders including late registration or entries which attract additional fees, you are committing to paying for them. 

3. Withdrawal and refunds policy 

    3.1 Academic registration and entries

Please refer to these details of when refunds may be made, including before the high late fee date or in respect of withdrawal from an examination due to candidate illness.

    3.2 Vocational registrations 

The registration fee for a BTEC learner following an academic year registration, will not normally be refunded if he/she withdraws from the programme. Please refer to our document on BTEC registration fees, timelines and refunds on our fees page for details of when refunds may be made. 

4. Data protection

Pearson acts as a Data Controller in respect of personal data collected by us in connection with a Customer’s Product purchase under these T&Cs. We will process all personal data in accordance with all relevant data protection legislation including the Data Protection Act 2018 and the General Data Protection Regulations (GDPR). Further information about our use of candidate personal data can be found in our Privacy Policy for candidates. 

5. Limitation of liability and limitation on claims

In no event will Pearson be liable for any indirect, consequential or special damages arising out of this agreement, purchase or use of Pearson Products or Services. Notwithstanding any other provision or agreement between the customer and Pearson, Pearson's total liability to any party, arising out of this agreement, purchase, or use of Products, except as it relates to Pearson's willful misconduct, will not exceed the amount paid by Customer for the products or services.

6. Use of product

Customer agrees to use any Products in accordance with all relevant Pearson and JCQ policies and regulations including but not limited to relating to test security, confidentiality, copyright and data privacy.  

Products may not be resold,transferred or otherwise further distributed in whole or in part without prior written permission from Pearson. Reselling or uploading or allowing to be resold or uploaded in whole or in part on any online site or by any other method is strictly prohibited and will disqualify the Customer from future purchases of Pearson Products or Services, and may result in prosecution and/or civil claim. The Customer's purchase of Pearson Products does not grant the Customer a right to reproduce additional copies of materials or content or enter any content into a computer medium, such as non-Pearson scoring system or software. 

No adaptations, translations, modifications, or special versions may be made without prior permission in writing from Pearson (see Section 9). Breach of these T&Cs may result in the revocation of a Customer's right to purchase.

7. Copyright 

Pearson Products are protected by various intellectual property laws, including copyright and trademark. Printing or reproducing copyright-protected materials or content, whether the reproductions are sold or furnished free for use, including reproduction of test items, scales, scoring algorithms, scored directions, or other content, is strictly prohibited by law and by these T&Cs. Customer acknowledges and agrees that the use or disclosure of Pearson confidential information may cause Pearson irreparable harm for which remedies other than injunctive relief may be inadequate.

8. Indemnification

To the extent permitted by law, Customer agrees to hold harmless, indemnify and defend Pearson from and against any and all claims, charges, demands, damages, liabilities, losses, expenses, and liabilities of whatever nature and howsoever arising (including but not limited to any legal or other professional fees and the costs of defending or prosecuting any claim and any loss of profit, goodwill, and any other direct or consequential loss) incurred or suffered by Pearson directly or indirectly by reason of any act or omission that the Customer commits in breach of these T&Cs and the obligations and warranties contained in them.

9. Requests for permission to license Pearson intellectual property

Requests to copy, translate, modify or adapt any Pearson product must be made in writing and directed to: permissions@pearson.com.

10. Payment

Payment for all fees is due 30 days from the date of the invoice. Payment cannot be withheld unless you dispute the amount of the charges by notifying us in writing, within 21 days of receipt of an invoice, giving full details of the amounts disputed and the reason you dispute the charges.

Pearson reserves the right to suspend a customer’s account if invoices are not paid in full by the due date. Where the account is suspended, the customer will not be able to make any further purchases until the account is settled in full or a payment plan agreed between Pearson and the customer.

Unless good reason is given for non-payment of invoices by the due date, late payment interest at the rate of 8% plus current bank rate, as per the Late Payment of Commercial Debts (Interest) Act 1998, will be charged.

Pearson Education Limited is registered for VAT. Our VAT registration number is GB2785371 21. The price stated on our Website is exclusive of any applicable value added or other sales tax. However, we will show the final price less any applicable discounts and including all delivery costs and the breakdown of any applicable value added tax (VAT) payable with your order on the page before you submit your order and on the invoice you will receive on supply/with the goods or on your digital receipt. Post and packing charges are also indicated separately on the invoice or on your digital receipt.

United Kingdom customers

VAT (Value Added Tax) at the prevailing rate in the UK will be charged where applicable. A breakdown of any VAT charged will be shown on the paper VAT invoice or on your digital receipt.

European Union customers

For customers throughout the European Union VAT will be applied to your order, where it is legally appropriate for us to do so, and will appear on the paper invoice or on your digital receipt. VAT will be payable at the applicable rate and may vary from country to country. 

If you are registered for VAT within the EU and do not wish to pay the tax on eligible products you will need to inform our Customer Services Department on 03301 289 126. Once you have informed us, you are able to order online. The VAT will be quoted in your online order, but your final invoice will have the VAT removed.

Other customers

For territories outside the European Union, VAT or other sales taxes may be charged where it is legally appropriate for us to do so.

Customs

When ordering goods for delivery overseas you may be subject to import duties and taxes, which are levied once the package reaches the specified destination. Any additional charges for customs clearance must be borne by you; we have no control over these charges and cannot predict what they may be. Customs policies vary widely from country to country, so you should contact your local customs office for further information. Please be aware that you must comply with all laws and regulations of the country in which you are receiving the goods.

All credit/charge card payments are subject to authorisation by the card issuer. If your payment is not authorised, we will cancel your order (and notify you that we have done so) and you must return the goods to us (if you have already received them) at your own expense. The goods remain our property until you have paid for them.

11. Modifications of terms and conditions

Pearson reserves the right to amend these T&Cs at any time without prior written notice. Pearson will always endeavour to ensure that its Customers have adequate notice of any changes in fees; however, we reserve the right to make changes to fees when necessary. The most current fees will be posted on our fees page.

Registrations and entries made after the published deadline will be subject to an additional late entry or late registration fee. Details of these fees are posted on our fees page

12. Complaints in relation to goods or services you have purchased online

If you have a complaint in relation to goods or services you have purchased, please contact us by submitting a case via our Support Portal.

13. Definitions and notes

  1. "T&Cs" means Pearson terms and conditions of sale and use and the qualifications and return policies referenced in these T&Cs. 

  2. "Pearson product(s)" means qualifications assessments, examinations, tests, or other assessments services or materials published or provided by Pearson.

  3. “Pearson” or “we”  means Pearson Education Limited.

  4. "Customer" means the purchaser and qualified user of a product, who are individually and collectively referred to as "Customer." This would usually be a Pearson approved centre.
